"Interim Agricultural Water Program purposes" shall mean the service of water pursuant to the Interim Agricultural Water Program and this Division IV (MWD Administrative Code), which is delivered and used for the growing or raising, in conformity with recognized practices of husbandry, for the purposes of commerce, trade, or industry, or for use by public educational or correctional institutions, of agricultural, horticultural, or floricultural products, and produced (1) for human consumption or for the market, or (2) for the feeding of fowl or livestock produced for human consumption or for the market, or (3) for the feeding of fowl or livestock for the purpose of obtaining their products for human consumption or for the market, such products to be grown or raised on a parcel of land having an area of not less than one acre utilized exclusively therefor.
(a)"Interim Agricultural Water Program purposes limited to the growing of field and nursery crops and row crops" shall mean the service of water related to the growing of crops generally planted and harvested annually or more frequently, and other Interim Agricultural Water Program purposes not included in the definitions of Sections 4106(b) and 4106(c).
(b)"Interim Agricultural Water Program purposes limited to the growing of trees and vines" shall mean the service of water limited to the growing of crops which are planted less frequently than annually in the expectation of long‑term yield therefrom.
(c)"Interim Agricultural Water Program purposes limited to the feeding of fowl or livestock" shall mean the service of water encompassing the raising of animals for human consumption or for the market or for the purpose of obtaining their products for human consumption or for the market."

Sec.162.3 MWD-IAWP Certification and Recertification Individuals applying for participation in the MWD IAWP shall certify that they are the owner or authorized agent of the owner of the property to receive water under the MWD IAWP and further certify that their respective water usage will meet the qualifications set forth in Sec. 162.2 and as modified from time to time by MWD. Upon submission and approval of the application for participation in the IAWP, applicants shall be classified as either "Certified Agricultural" or "Certified Agricultural/Domestic," and be eligible to receive the established water rate for the assigned classification. Applications for participation shall not be accepted or processed during or under substantial threat of a water supply reduction provided by the IAWP. Participants may be subject to periodic re-certification as determined by MWD, the SDCWA, or the District.
Sec. 162. 4 Acknowledgement Individuals participating in the IAWP shall acknowledge that:
(a) Water received under the IAWP is a non-firm, interruptible supply, subject to early and accelerated mandatory supply reduction as is from time to time determined necessary by MWD and the SDCWA. At this time, the supply reduction schedule is as follows:

(b) Water use under the IAWP supply is subject to periodic data and field audits and participants agree to respond in a timely manner to requests for information and access to properties receiving water under the IAWP.
(c) Failure to respond in a timely manner to information requests, associated data and field audits or recertification, or failure to provide reasonable access to properties receiving water under the IAWP will result in automatic removal of the subject property from the IAWP, subject to the conditions set forth in sub-section 162.5(c) of this Article, and subsequent water use on the property will be classified and billed as "Domestic/Commercial."

(d) If, as a result of an audit, it is determined that IAWP supply was used on property and/or for purposes not meeting the qualifications established by MWD, then said usage may be subject to assessment of retroactive supplemental water rates, penalties and charges as required by MWD, the SDCWA, or the District, which the participant agrees to pay;
(e) If an audit determines that the subject property and/or water use on the property does not qualify for the IAWP, then the property and associated water account will be removed from the IAWP as provided for and subject to the conditions in sub-section. 162.5 (c) of this Article, and subsequent water use on the property will be classified and billed as "Domestic/Commercial."
Sec. 162.5 Exit and Re-entry into the IAWP. Participants may elect to exit the IAWP under the following condition:
(a) Participants shall not exit the program during or under substantial threat of a mandatory water supply reduction provided for by the IAWP;
(b) Participants exiting may re-enter the program after a minimum one-year waiting period from the date of exit and only if there is no substantial threat of or actual mandatory IAWP supply reduction in force at the time of application for re-entry into the IAWP.
(c) Participants exiting the program shall remain subject to mandatory reductions for a minimum of one-year after exiting the program or as long as their individual usage was included in whatever base period is utilized by MWD or the SDCWA to determine the degree of supply reduction, irrespective of the water usage classification or rate for the subject property at the time of the mandatory water use reduction under the IAWP.
Sec 162.6 Implementation of Mandatory IAWP Supply Reductions Actual implementation of mandatory supply reductions shall be based upon levels of reduction required by MWD and the SDCWA. To achieve the required levels of use reduction and avoid the maximum extent possible any operational or financial sanctions which may be imposed on the District by MWD or the SDCWA, the District will utilize one or a combination of methods, including: timely notice of pending reductions, water management information dissemination, individual participant water budgets and use reduction targets, assessment of financial disincentives, and individual meter flow reduction devices.
